About these terms

These terms govern your use of the Aely app and the aelycycle.app website, whose publisher is identified on our Legal notice page (“we”).

By using Aely, you accept these terms. Our Privacy Policy explains how your data is handled.

What Aely is

Aely helps you track your menstrual cycle, log symptoms and moods, follow a pregnancy, understand patterns and read articles about cycle health.

Aely is not a medical device

Aely is not a medical device and does not provide medical advice, diagnosis or treatment. Predictions, fertile windows, ovulation estimates, patterns, anomaly alerts, reports and articles are informational estimates based on what you log. They can be wrong, especially when cycles are irregular or data is missing.

• Do not use Aely as contraception or rely on it alone to avoid or achieve a pregnancy.
• Always ask a doctor, midwife or other qualified professional about your health, and never delay seeking care because of something shown in the app.
• In an emergency, call your local emergency number.

Who can use Aely

Aely can be used from age 10. Before 15, creating an account, turning on backup or using Partner Mode requires the consent of a parent or legal guardian, who accepts these terms on your behalf. Some content and features are only available from 15.

Your account

You can use Aely without an account. If you create one with Apple or Google, keep access to that account secure: anyone who can sign in to it can see your backed-up data. You are responsible for what you log in the app.

Data kept only on your phone is lost if you lose the phone or delete the app, unless you have turned on backup.

Partner Mode

Partner Mode lets you share a read-only view of chosen information with one person. Only invite someone you trust. You decide what they see and can end sharing at any time.

If you are invited as a partner, you agree to use what is shared with you only to support the person who shared it, and never to pressure, monitor or harm them. We may end a link that is used abusively.

Aely+ subscription

Some features, including advanced predictions and patterns, reports, PDF export and Partner Mode, are part of the paid Aely+ subscription.

• Purchase: Aely+ is sold as a monthly or yearly subscription through the App Store or Google Play. The price, billing period and any free trial are shown in the app before you confirm.
• Payment and renewal: payment is charged to your store account when you confirm, or at the end of the free trial. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
• Cancellation: manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your Aely account does not cancel it.
• Refunds: refunds and the right of withdrawal are handled by Apple or Google under their own terms.
• Restoring: you can restore an active subscription on a new device with Restore purchases.

We may change the price of Aely+. Any change applies from your next renewal and is announced in advance by the store, where you can cancel.

Content and intellectual property

The app, its design, the Aely name and logo, the mascot and the library articles belong to us or our licensors. We grant you a personal, non-exclusive and non-transferable right to use Aely for your own, non-commercial purposes.

You may not copy, resell or redistribute the app or its content, try to access other users’ data, interfere with our servers, or use Aely for anything unlawful.

Availability and changes to the app

We work to keep Aely available and accurate, but we cannot guarantee that it will be free of errors or interruptions. We may add, change or remove features. If we remove a paid feature, we will tell you in advance.

Liability

Nothing in these terms limits your statutory rights as a consumer, or our liability where the law does not allow it to be limited.

Within those limits, we are not liable for decisions made on the basis of predictions or content shown in the app, for data lost because it was only stored on a phone that was lost, reset or damaged, or for indirect damage.

Ending your use

You can stop using Aely at any time and delete your data, as explained on the Delete my data page. We may suspend or close an account that seriously or repeatedly breaks these terms, after letting you know when possible.

Changes to these terms

We may update these terms, and change the date at the top. If a change is significant, we will let you know in the app before it applies. If you do not agree, you can stop using Aely and delete your data.

Governing law and disputes

These terms are governed by French law. If you live in another country of the European Union, you keep the protection of the mandatory rules of that country.

If you have a problem, contact us first at support@aelycycle.app so we can try to resolve it together. If we cannot, you can go to the competent courts.
